Terms of Service

We Sell Your House is a marketing and content-automation platform operated by Alfano Technologies Inc. (“We Sell Your House”, “we”, “us”). These Terms govern your use of the platform and the marketing services we provide. By creating an account, subscribing, or using the platform, you agree to these Terms.

Registered professionals only. This platform is for individuals and firms currently registered with the Real Estate Council of Ontario (RECO) under the Trust in Real Estate Services Act, 2002 (TRESA) as a salesperson, broker, or brokerage. It is not open to unregistered persons or to pre-registration real estate students.

1. Who we are, and who we are not

We Sell Your House is a marketing service provider. We are not a real estate brokerage, we do not trade in real estate, and we are not registered with RECO. We do not represent buyers or sellers, give real estate advice, or take part in any trade in real estate. We produce and publish marketing content about your listings on your behalf and at your direction.

2. Eligibility: registered and licensed registrants only

To subscribe to or appear on We Sell Your House, you represent and warrant that:

  • You are currently registered with RECO under TRESA as a salesperson, broker, or broker of record, or you are a brokerage registered with RECO; and
  • Your registration is valid and in good standing, and is not suspended, revoked, surrendered, or subject to any condition that would restrict your advertising; and
  • You are authorized by your brokerage to advertise the listings you submit, and your use of this platform complies with your brokerage’s policies.

Pre-registration real estate students, unregistered assistants, and any person not registered with RECO may not subscribe, advertise, or be listed. We may request proof of registration at any time and may verify your status against RECO’s public register. If your registration lapses, is suspended, or ends for any reason, you must notify us immediately and we may suspend or remove your profile and listings.

3. Your advertising compliance is your responsibility

You remain solely responsible for ensuring that all content we produce and publish for you complies with TRESA, the RECO Code of Ethics, and the rules of any real estate board or association you belong to. By submitting a listing or approving content, you confirm that the content meets the following requirements, among others:

  • It clearly and prominently includes the name of the registrant exactly as registered with RECO.
  • It includes the name of the brokerage exactly as the brokerage is registered with RECO.
  • Where you are identified by name, the name used is the name in which you are registered.
  • It is not false, misleading, or deceptive, and it does not omit anything that would make it misleading.

You agree to review and approve marketing content and to monitor what is published on your channels. You are responsible for correcting or removing any content that is inaccurate or non-compliant. We will act on your instructions to edit or remove content promptly.

4. Listings, photos, and the licence you grant us

You are responsible for the accuracy of every listing and for the rights to every photo, video, floor plan, description, headshot, biography, logo, and other material you submit or that we collect from your brokerage listing page at your direction. You represent that you own or are licensed to use all such materials and that we may use them to create and publish marketing content on your behalf.

You grant us a non-exclusive, royalty-free licence to host, reproduce, adapt, and publish those materials and the content we create from them, for the purpose of providing the service, including on your We Sell Your House profile page and on the social media accounts you connect.

5. Social media publishing

When you connect a social media account or authorize publishing, you authorize us to post content to that account on your behalf. You remain responsible for compliance with each platform’s terms and for the content posted. You may revoke publishing access at any time.

6. Listing display and the “Sold” lifecycle

Active listings appear on your profile page and on the public Listings page, newest first. A listing marked Sold remains on your profile page for up to 60 days and is removed from the public Listings page 7 days after it is marked Sold. We may remove content at any time at your request or to comply with these Terms.

7. Fees, billing, and taxes

  • Subscriptions are $49.99 per month, or $499.99 per year (two months free), in Canadian dollars, unless otherwise stated at checkout.
  • Applicable taxes, including 13% Ontario HST, are added at checkout. Alfano Technologies Inc. HST registration number: 714103231RT0001.
  • Payments are processed by our third-party payment processor (Stripe). We do not store your full card details.
  • Subscriptions renew automatically for the same term until cancelled. You may cancel at any time, effective at the end of the current billing period.
  • Except where required by law, fees already paid are non-refundable, and cancelling does not entitle you to a refund for the remainder of a paid term.

8. Acceptable use

You agree not to use the platform to publish anything unlawful, infringing, defamatory, discriminatory, false, or misleading, and not to advertise a listing you are not authorized to advertise.

9. Intellectual property

You keep ownership of the materials you provide. We keep ownership of the platform, our software, and our own brand. Marketing content we create for you may be used by you in connection with the advertised listing; it must still meet the compliance requirements in Section 3.

10. Disclaimers

The platform and services are provided “as is”. We do not guarantee any particular result, including any sale, lead, view, or engagement. We do not provide legal, tax, or real estate advice. Nothing here creates an agency, brokerage, or employment relationship between us and you.

11. Limitation of liability and indemnity

To the extent permitted by law, our total liability arising out of or relating to the service is limited to the fees you paid us in the three months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

You agree to indemnify and hold us harmless from any claim, penalty, or loss arising from your content, your listings, your registration status, or your breach of TRESA, the RECO Code of Ethics, real estate board rules, or these Terms.

12. Suspension and termination

We may suspend or terminate your access immediately if your RECO registration lapses or is suspended or revoked, if you breach these Terms, or if we are required to do so by RECO, a real estate board, or a court. You may stop using the platform and cancel at any time.

13. Privacy

We handle personal information in accordance with applicable Canadian privacy law, including PIPEDA. We collect only what we need to provide the service.

14. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will provide notice. Continued use after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of the Province of Ontario and the laws of Canada that apply there. The courts of Ontario have jurisdiction.
